By accessing or using MenuScout ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
MenuScout is a competitive intelligence platform for restaurant owners that monitors competitor menu prices and provides pricing insights. The Service collects publicly available menu data from third-party food delivery platforms.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities under your account
4. Subscription and Billing
Paid subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method for all fees incurred. Subscription tiers include:
- Starter ($9/month): 3 competitors, daily updates, 30-day history
- Pro ($24/month): 15 competitors, 3-hour updates, 90-day history, email alerts
- Business ($79/month): Unlimited competitors, hourly updates, unlimited history, API access
5. Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months of service or unused features.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any systems or networks
- Interfere with or disrupt the Service
- Resell or redistribute Service data without authorization
- Use automated means to access the Service except through our official API (Business tier only)
7. Data Collection
The Service collects publicly available menu data from third-party platforms. We make no guarantees about the accuracy, completeness, or timeliness of this data. Competitor menu information is provided for informational purposes only.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by MenuScout and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our consent.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR RELIABILITY OF DATA PROVIDED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUSCOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
